Terms of Service

Last updated: Draft — pending legal review

Draft — pending legal review. This is a starting point prepared for Provider Essentials and has not yet been reviewed by a lawyer or finalised with our registered business details. It isn't legal advice.

These Terms of Service ("Terms") govern your access to and use of Provider Essentials, operated by [Attara Pty Ltd] (ABN [ABN]) ("we", "us", "our"). By using our website, generator, or documents (together, the "Service"), you agree to these Terms. If you don't agree, please don't use the Service.

1. What we provide

Provider Essentials is a document generator for Australian NDIS providers. We supply professionally engineered document templates and resources (for example service agreements, policies, procedures, forms, and registers) and a generator that fills and brands those documents with your business details so you can preview and download them as finished PDFs.

Our documents are professional resources and starting points. They are not legal, financial, or compliance advice, and using them does not guarantee any particular audit, registration, or regulatory outcome. You are responsible for reviewing and adapting every document to your own circumstances. See our Acceptable Use & Disclaimer for more.

2. Using the Service

To build documents and pay per download, there's no account or login — you work entirely in your own browser. If you take out a subscription, you access it by verifying your email address (there is no password to manage). You're responsible for the information you enter and how you use the documents you download. You must be at least 18 and authorised to act for the NDIS provider or organisation you represent.

3. Pricing & payment

The Service is free to build and preview. To download a finished document you either pay a one-time charge per document (or reusable blank), or take out a subscription for unlimited downloads. Subscriptions are billed in advance on a recurring basis (monthly, per seat, plus any additional team members) until you cancel. Prices are shown in Australian dollars (AUD) and, where applicable, include GST.

Payments are processed securely by our payment provider, Stripe; we do not store your full card details. For one-time purchases, the price shown at checkout is what you pay and we don't charge you again unless you buy something else. Subscriptions renew automatically until cancelled — see the Refunds & Cancellations policy.

4. Your licence to use the documents

When you purchase a document, we grant you a non-exclusive, non-transferable licence to generate, customise, download, and reproduce that document for the internal operations of a single NDIS provider or organisation (one ABN). Documents you download are yours to keep and use internally — there's nothing to renew.

  • You may: edit the documents, add your branding, and use them to run your own NDIS services.
  • You may not: resell, sublicense, share, or redistribute the templates (modified or not) to other providers or the public, or present them as your own product.

5. Ownership & intellectual property

All intellectual property in the Service and the underlying document templates remains owned by [Attara Pty Ltd]. The content you add (your business details, branding, and the participant or operational information you enter) remains yours. We don't store that content — it's used only momentarily to render your PDF and then discarded (see our Privacy Policy).

6. Free to build, pay to download

You can build and preview any document for free, as many times as you like. To download the finished PDF you either pay once per document or use an active subscription. Either way there's nothing for us to store — the details you enter live only in your own browser and on our server momentarily while your PDF is generated.

Anything you have downloaded is yours to keep and use. Because we keep no copy, please save your finished documents to your own system.

7. Your responsibilities

You are responsible for ensuring the documents you generate are appropriate, accurate, and compliant for your organisation before you rely on them — including obtaining your own professional advice where needed. We provide the framework; how you complete, adapt, and use it is your decision.

8. Acceptable use

You agree not to misuse the Service — including by attempting to breach its security, scraping or bulk-extracting templates, reselling access, or using it for anything unlawful. Our full Acceptable Use & Disclaimer forms part of these Terms.

9. Consumer guarantees & liability

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law or other laws that cannot lawfully be excluded.

Subject to those rights, and to the maximum extent permitted by law, the Service and documents are provided "as is", and [Attara Pty Ltd]'s total liability arising out of or in connection with the Service is limited to the amount you paid us in the 12 months before the relevant claim. We are not liable for indirect or consequential loss.

10. Suspension & termination

You may stop using the Service at any time. We may suspend or terminate access if you materially breach these Terms (for example by redistributing our templates). Provisions that by their nature should survive termination — including licence limits, IP ownership, and liability — will survive.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll take reasonable steps to let you know (for example by email or a notice on the site). Continuing to use the Service after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of [State/Territory], Australia, and you submit to the non-exclusive jurisdiction of the courts of that place. Our registered address is [registered business address].
